General terms and conditions

1. Scope

The following T&Cs apply to all orders placed via our online shop.

2. Contractual partner, formation of contract

The purchase contract is concluded with music world Meinolf Kahrig e.K..

The display of products within the online shop constitutes a binding offer on our part to enter into a contract vis-à-vis the items. You may place our products in your basket without obligation and amend your entries at any time prior to submitting a binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in your basket. Once you have sent your order you will immediately receive a confirmation via e-mail.

3. Contract language, saving of the contract text

The languages available for concluding the contract are German and English.

We save the text of the contract and forward the order data and our T&Cs to you by e-mail. You may also view the text of the contract in our customer login area.

4. Delivery conditions

Delivery costs are added to the product prices as displayed. Delivery charges are explained within individual product offers.

5. Payment

The following payment methods are basically available in our online shop:

Advance payment
If you select advance payment we provide you with our bank details in a separate e-mail and deliver the goods on receipt of funds.

Cash on delivery
You will directly pay the purchase price with the deliverer. Additional cost of 4,99 Euro will apply, unless you are a consumer who has his habitual residence in France or Austria.

PayPal Plus
Within the context of the PayPal Plus payment service, we offer you various payment methods as PayPal services. You will be forwarded to PayPal's online website. You may enter your payment details there and confirm the use of your data by PayPal and the payment instructions to PayPal.

If you have selected the PayPal payment type, in order to pay the invoice amount, you must be registered there or register first and identify yourself with your access data. The payment transaction will be carried out automatically by PayPal directly after confirmation of the payment instructions. You will receive additional information during the ordering process.

If you have selected the credit card payment type, in order to pay the invoice amount, you do not need to be registered with PayPal. The payment transaction will be carried out by your credit card company upon request by PayPal and debited to your card, directly after confirmation of the payment instructions and after your identification as the legal cardholder. You will receive additional information during the ordering process.

If you have selected the direct debit payment type, in order to pay the invoice amount, you do not need to be registered with PayPal. With the confirmation of the payment instructions, you are granting PayPal a direct debit mandate. PayPal will inform you separately about the date of the account debit in an advance notification (pre-notification). With the submission of the direct debit directly after confirmation of the payment instructions, PayPal will request its bank to initiate the payment transaction. The payment transaction is automatically carried out and your account is debited. You will receive additional information during the ordering process.

If you have selected the invoice payment type, in order to pay the invoice amount, you do not need to be registered with PayPal. After a successful address and creditworthiness check and placement of your order, we will assign our claim to PayPal. In this case, you may only pay to PayPal with a debt-discharging effect. For payment processing via PayPal – in addition to our GTC – the GTC and data protection policy of PayPal shall apply. SOFORT Online Bank Transfer                                           
After placement of the order, you will be forwarded to the online SOFORT GmbH website. In order to pay the invoice amount via SOFORT, you must have an online banking account with PIN/TAN process for participating in SOFORT, identify yourself accordingly and confirm the payment instructions to us. You will receive additional information during the order process. The payment transaction will be carried out by SOFORT and debited to your account directly thereafter.

Amazon Pay
During the ordering process you will be forwarded to the online Amazon website before completing the ordering process in our online shop. In order to process the ordering process via Amazon and pay the invoice amount, you must be registered there or register first and identify yourself with your access data. There, you may confirm the delivery address and payment method stored with Amazon and confirm the use of your data by Amazon and the payment instructions to us. After this, you will be returned to our online shop, where you may complete the ordering process.
Directly after the order, we request Amazon to initiate the payment transaction. The payment transaction is carried out automatically by Amazon. You will receive additional information during the ordering process.

Payment by instalments
In collaboration with the online services provider Consors Finanz, we can offer you the option of payment by instalments. A successful address- and credit check is precondition. Cash payment on collection
You pay the invoice amount in cash on collection.

6. Retention of title

The goods shall remain our property until full payment is made.

7. Damage during delivery

If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.

8. Warranty and guarantees

We are under a legal duty to supply products that are in conformity with this contract.
For consumers, statutory warranty rights governed by the law of the country where the consumer has his habitual residence apply. Information on any additional guarantees and their precise conditions that may apply can be found next to the product and on specific information pages in the shop, if applicable.

9. Liability

We shall in any case be liable without limitation for claims due to damages that have been caused by us, our legal representatives or legal agents

  • for injury to life, limb or health
  • for deliberate or grossly negligent breach of duty
  • for guarantee commitments, where agreed
  • towards consumer.

Except these cases, our civil law liability is limited to the foreseeable and direct damages at the time of contract conclusion.

10. Online dispute resolution

The European Commission provides a platform for online dispute resolutios (ODR) which can be accessed at https://ec.europa.eu/consumers/odr/. Consumers have the possibility to use this platform for resolving their disputes. 
In order to settle disputes arising from a contractual relationship with a consumer or from whether such a contractual relationship exists at all, we are obliged to participate in dispute settlement proceedings before a consumer dispute resolution body. The competent body in this matter is: Allgemeine Verbraucherschlichtungsstelle des Zentrums für Schlichtung e.V., Straßburgerstraße 8, 77694 Kehl am Rhein, Germany, www.verbraucher-schlichter.de. We will participate in a dispute settlement procedure before this authority.

11. 3-year music world warranty

For all products purchased from music world, we shall grant an additional year of warranty - therefore, a total of 3 years’ warranty, in consideration of the following conditions, provided that the Customer is a consumer within the meaning of Section 13 BGB [German Civil Code]. The Customer shall only be entitled to the extended warranty and it cannot be assigned.

10.1 For all defects occurring during the extended warranty, which are due to a material defect or manufacturing defect, music world shall provide a warranty.

10.2 All computer items and wear-and-tear parts, such as strings, light bulbs, LED spotlights, faders, sticks, rechargeable batteries/batteries, all tubes (also installed), etc. are excluded from the extended warranty, as they are subject to used-related or conventional wear and tear.

10.3 The following are also excluded:
- Product defects resulting from incorrect use or non-observance of the operating instructions, improper use, overstressing or deficient maintenance and care,
- Damage and defects to the product with the use of third-party parts, which are not original parts of the manufacturer,
- Products, on which unauthorised attempts at repair have been made,
- Products with deviations from target values, which are insignificant for the product’s suitability for use.

 

12. 8-day price guarantee

If you find an identical product from our range with another authorised German dealer for this product at a lower price with the same performance within 8 days from the purchase date, you will receive a payment from us for the difference. Optionally, we reserve the right to change the purchase contract! However, the goods must be returned to us in an absolutely proper condition, without any traces of use and in the original packaging. The prerequisite is that the respective item is “immediately available for delivery” with the respective dealer at the time of assertion of the “8-day price guarantee”. Offers via the “ebay” auction platform are not taken into consideration. Possible shipping costs of other dealers are taken into consideration in the price calculation. Incorrect prices, errors of other suppliers and printing errors are not taken into consideration.

Exceptions from the “8-day price guarantee” are:
- used products, exhibited goods, returns and auction items and ebay offers
- large-scale discount offers of our competitors (e.g. anniversary sale, clearance sale, etc.)
- all Mac/PC and software items

 

13. Bonus points

For each online purchase, bonus points will be credited to your online customer account. An exception exists for payments via amazon payment, because you purchase as a guest with this payment and therefore do not open any customer account. For each € 1.- of purchasing value, you will receive 0.2 bonus points, a maximum of 400 points per order. The total of the respective bonus points will be rounded down to full points. You can view your current balance of bonus points at any time in your online customer account. The bonus points that you have collected can be directly offset from your purchase amount with your next online purchase (no earlier than 30 days after acquiring the points). The minimum redemption value is 1 bonus point = €0.05. You can redeem a maximum of 400 points, i.e. € 20.00 per purchase. Your order will be charged less by the relevant amount at the end of the order process. The bonus points are only valid from the respective purchase date and will lapse automatically after the effective date.

The bonus points programme starts from 10 November 2009.  Orders in the past cannot be subsequently allocated bonus points. music world reserves the right to terminate the bonus programme at any time or to change the allocation of points on the basis of the purchasing value. Bonus points cannot be paid out in cash and cannot be transferred to other Customers. If orders or purchase contracts are cancelled in accordance with Section 4.2., bonus points that have been collected with this order shall be deleted. Bonus points that have already been redeemed shall lapse upon cancellation and shall not be credited again. Bonus points will be credited to your online account as soon as your order is invoiced by us and dispatched. Orders via telephone and/or in shop premises can unfortunately not be provided with bonus points.
